При заключении сделки купли-продажи квартиры, дома, прочей недвижимости, по законодательству Украины, обе стороны сделки обязаны платить налоги. Вопрос — сколько всего надо заплатить? И как не платить лишнего?
Налоги продавца недвижимости.
Продавец квартиры должен заплатить 1% Государственной пошлины, если квартира, дом находилась в собственности свыше 3 лет. Если квартира была в собственности менее 3-х лет или происходило отчуждение жилья более 1 раза за налоговый год, собственник при сделке должен уплатить 1% госпошлины, 5% налога на доход и 1,5% — военный сбор. Налогом не облагается жилье, если оно было получены в наследство по закону или по завещанию.
В случае, если продавец является нерезидентом Украины и недвижимость, была у него в собственности менее 3 лет, или сделка продажи осуществляется недвижимости чаще 1 раза за отчетный налоговый год, то налоги составят — 1% госпошлины, 15% налога на доходы физлиц. Если сумма дохода превышает 10-и кратный размер минимальной заработной платы, ставка налога составит 20%) и 1,5% военный сбор.
Налоги покупателя квартиры, дома.
Покупатель недвижимости платит 1% от стоимости квартиры или дома в Пенсионный фонд. Эту сумму должны заплатить и резиденты, так и нерезиденты Украины.
В качестве исключения — договор дарения и получение жилья по договору пожизненного содержания.
Льготники
Льготы имеют силу только у государственного нотариуса. Если один из участников является льготником, то сумму государственной пошлины платит второй из участников. И только если оба участника являются льготниками, то госпошлина не уплачивается.
Льготами, согласно Декрета КабМина Украины «О государственной пошлине» являются:
- инвалиды I и II группы;
- инвалиды ВОВ и семьи воинов, которые погибли или пропали без вести;
- лица, отнесенные к 1 и 2 категории пострадавших вследствие Чернобыльской катастрофы;
- граждане, которые имеют статус пострадавшего в следствии аварии на ЧАЭС 3-ей и 4-ой категории, которые по состоянию на 01.01.1993 проживали и работали в зоне обязательного отселения не меньше 2 лет (третья категория), не меньше 4 лет (четвертая категория).
Сумма от которой исчисляется государственная пошлина и отчисление в Пенсионный фонд является рыночная стоимость квартиры, дома, другой недвижимости, определяемая сертифицированными оценщиками. Стоимость наших услуг является минимальной.
